El Tribunal de Justicia Europeo ha fallado hoy a favor de establecer una retroactividad total en la devolución de las cláusulas suelo de los contratos hipotecarios. 

La sentencia, contradice la interpretación del Tribunal Supremo español, que en 2013 anuló las cláusulas suelo abusivas, pero limitó el reintegro de las cantidades cobradas de más e sólo impusieron la devolución de lo cobrado a partir del 9 de mayo de 2013, por entender que hasta ese momento las entidades financieras podían asumir que las cláusulas eran legales, así como para evitar el impacto económico de una devolución completa.

El fallo de la Corte de Luxemburgo establece que en el caso de las cláusulas suelo que sean nulas por su opacidad, la banca debe devolver lo cobrado por ellas a sus clientes con retroactividad total, lo que supone que la banca tendrá que abonar a su clientela todo lo cobrado por estas condiciones hipotecarias, que en muchos casos comenzaron a activarse a finales de 2009, debido a que la caída de tipos topó con los suelos establecidos en los créditos.

The European Court of Justice today ruled in favour of establishing a total retroactivity in the return of the floor clauses of the mortgage contracts.

The judgment contradicts the interpretation of the Spanish Supreme Court, which in 2013 annulled the abusive ground clauses, but limited the reimbursement of the excess of collected amounts and only imposed the refund of what was collected starting from 9 May 2013. Until that time financial institutions could assume that the clauses were legal, as well as to avoid the economic impact of a full refund.

The judgment of the Luxembourg Court establishes that in the case of ground clauses that are void because of their opacity, the bank must return the amount charged by them to its customers with total retroactivity, which means that the bank will have to pay its customers everything charged for these mortgage conditions, which in many cases began to be activated at the end of 2009, because the fall in rates hit the floors established in the credits.

Der Europäische Gerichtshof hat sich heute für eine Etablierung einer vollständigen Rückwirkung in den Hintergrundklauseln von Hypothekenverträgen entschieden.

Das Urteil steht im Widerspruch zur Auslegung des spanischen Obersten Gerichtshofs, der im Jahr 2013 die missbräuchlichen Bodenklauseln anullierte, aber die Erstattung der Mehrbeträge beschränkte und nur die Erstattung der Summen ab dem 9. Mai 2013 verhängte. Bis dahin konnten die Finanzinstitute davon ausgehen, dass die Klauseln legal waren, und um die wirtschaftlichen Auswirkungen einer vollen Rückerstattung zu vermeiden.

Das Urteil des Gerichts Luxemburg legt fest, dass im Fall von Grundklauseln, die wegen ihrer Opazität ungültig sind, die Bank das in Verbindung mit diesen von den Kunden Kassierte, in voller Rückwirkung zurück erstatten muss, was bedeutet, dass die Banken an ihre Kunden all das unter den Bedingungen dieser Hypotheken Bezahlte, die in vielen Fällen Ende 2009 aktiviert wurden, da der Zinsrückgang  an den etablierten Krediten scheiterte, erstatten muss.
